These Terms and Conditions ("Terms") govern your use of the Houseler platform operated by Datasamy, Inc. doing business as Houseler ("Houseler," "we," "us," or "our") at www.houseler.com (the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access.

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Violate any applicable law or regulation
  • Send unsolicited or unauthorized SMS messages, spam, or bulk communications that violate the Telephone Consumer Protection Act (TCPA) or similar laws
  • Upload or transmit malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, crawl, or use automated means to access the Service without permission
  • Impersonate another person or entity
  • Use the Service to harass, abuse, or harm others

3. SMS and Communication Compliance

When using our SMS features (appointment reminders, follow-ups, marketing campaigns), you are responsible for:

  • Obtaining proper consent from your customers before sending SMS messages, as required by the TCPA and applicable state laws
  • Honoring opt-out requests promptly — customers who reply STOP must be removed from future messages
  • Including proper identification in marketing messages
  • Complying with all applicable telecommunications regulations
  • Not sending messages outside of reasonable business hours unless your customer has consented

We provide tools to help you manage consent and opt-outs, but compliance with SMS regulations is ultimately your responsibility. Violation of SMS laws may result in suspension or termination of your account.

4. Your Data

You retain ownership of all data you submit to the Service ("Your Data"), including customer information, appointment records, and business data. You grant us a limited license to use Your Data solely to provide and improve the Service.

You are responsible for the accuracy and legality of Your Data. You represent that you have all necessary rights and consents to store and process customer information through the Service.

We will not access, use, or share Your Data except as described in our Privacy Policy or as necessary to provide the Service.

5. Subscription and Billing

The Service is offered on a subscription basis. By subscribing, you agree to pay the applicable fees as described on our pricing page. Subscriptions automatically renew unless cancelled before the renewal date.

  • Fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days' notice — changes apply at your next renewal
  • Failure to pay may result in suspension or termination of your account

6. Free Trial

We may offer a free trial period. At the end of the trial, your account will be converted to a paid subscription unless you cancel. We will notify you before the trial ends.

7. Intellectual Property

The Service, including its design, code, features, and documentation, is owned by Houseler and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

The Houseler name, logo, and related marks are our trademarks. You may not use them without our prior written consent.

8. Service Availability

We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Houseler shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, secure, or available at all times, or that it will meet your specific requirements.

11. Indemnification

You agree to indemnify and hold harmless Houseler, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party, including your customers.

12. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in conduct that we reasonably believe is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. We will retain Your Data for 30 days after termination to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

13. Dispute Resolution

Any disputes arising from these Terms or the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English. You agree to waive any right to a jury trial or to participate in a class action.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Houseler regarding the Service.
